Bad news for generative AI artists.
You’ll have to put a little more leg work into your AI images before you get that sweet, sweet copyright.
At least in the U.S.
The U.S. copyright office gave guidance on the issue of who owns AI-generated art.
The short answer? It’s complicated. The long answer?
Something called “human authorship.”
The office equated a human prompting an AI model to commissioning an artist. That means the AI/company owns the work. Not the human.
But wait! There’s hope. If you can prove you put a significant amount of effort into adjusting it, you own it. Think heavy photoshop skills.
Sounds ambiguous? It’s supposed to be. They flat-out said they’ll handle these things on a case-by-case basis.
We’re still waiting for the first high-profile legal case involving generative AI art. Perhaps the attorneys will be AI themselves?

Take a photo of your dog. Feed it through Luma AI’s realtime AI model. Transform that photo into a realistic 3D dog model that you can place and use in any video.
Sounds crazy? Not so much.
Luna AI announced their AI plugin for Unreal Engine 5 that lets you do exactly that.
Back up. How does Luna turn photos into models?
Using Neural Radiance Fields, or NeRFs.
Simple explanation? They analyze a photo and its light sources, and generate a 3D model from it.
Best part? It can run locally on your computer.
Midjourney for video is close. We're officially excited.
😭 Germany says “Hey, wait a second…we can ban ChatGPT too!”

Do they really use gavels in court?
Big news! Germany remembered they’re part of the EU.
Remember last week how Italy banned ChatGPT? Because they suspect it violates the EU’s data privacy policy?
The German commissioner for data protection said that a similar ban is “possible”.
In principle.
You know, because they’re both countries in the EU.
This seems like a threat at this point; Germany in no way signaled they’ll actually do this.
It's kind of serious stuff though.
Remember years ago when every company you ever interacted with sent you an email? An email that said “We’re updating our privacy policy”?
That’s because they were TERRIFIED of violating GDPR.
Let’s see how OpenAI handles the same risk.
